Rep. McKillip Introduces Legislation to Protect Property Rights of Georgia Landowners

ATLANTA – State Representative Doug McKillip (R-Athens) announced today the introduction of House Bill 102. This legislation would protect property placed in conservation easements.

“Land placed in a conservation easement is typically rarely visited, making the land particularly susceptible to squatters and other adverse possessors. As a result, a complete stranger, or even a neighboring landowner, could begin using the land and eventually become entitled to claim legal title of the property,” said Rep. McKillip. “HB 102 puts an end to this possibility, assuring land owners that title to their property placed in conservation easements is secure.”

HB 102 provides that any action for adverse possession must be brought within four years of the filing of a qualified conservation easement on the property. This simple change would promote accurate land records for conservation easements in Georgia. It would also help prevent surprise land claims and ensure clean titles for those easements.
