Rep. Yasmin Neal Urges Clayton County Board of Commissioners to Abandon Local Ordinance to Fill Vacancies for Elected Positions

ATLANTA – State Representative Yasmin Neal (D-Jonesboro) yesterday submitted a letter urging the Clayton County Board of Commissioners to halt any consideration of Ordinance 2022-271, local legislation which would allow the Clayton County Board of Commissioners to fill vacancies of local elected officials, including the board.

“This ordinance must be tabled as it may exceed what the board is allowed to do and could even interfere with the constitutional right of the citizens of Clayton County,” said Rep. Neal. “After carefully reviewing this proposed ordinance with the Georgia General Assembly’s Office of Legislative Counsel, I want to urge the Clayton County Board of Commissioners to abandon this effort and any future efforts to propose these types of local ordinances.”

According to Clayton County’s public website, this local ordinance seeks to clarify the process for filling vacancies on the board of commissioners to be consistent with state law and establish the policy for filling vacancies in offices of constitutional officers where not otherwise provided by state law.

The Clayton County Board of Commissioners will hold a meeting to consider Ordinance 2022-271 today, Tuesday, December 20, 2022, at 6:30 p.m. A copy of the Clayton County Board of Commissioner’s meeting agenda for today can be found here.
