ATLANTA – State Representatives Viola Davis (D-Stone Mountain), Kim Schofield (D-Atlanta) and Sandra Scott (D-Rex) urge Georgia homeowners to voice their concerns regarding Homeowner Associations (HOAs), Property Owner Associations (POAs) and Condominium Associations at an upcoming Senate Urban Affairs Committee meeting on Thursday, September 18, 2025, at 1 p.m. in room 307 of the Coverdell Legislative Office Building in Atlanta. These representatives also highlight the Senate Rules Subcommittee on Homeowners Associations meeting that took place on Tuesday, September 16, 2025, which heard legislation regarding POAs, and they encourage Georgians to attend any future meetings. “Too many Georgians have been stripped of their rights by unregulated HOAs,” said Rep. Davis. “This week’s hearings are about transparency, accountability and protecting the American Dream of homeownership. We need homeowners to show up, share their stories and help us fight back.”
“There is not a week that goes by that I don’t hear from families harmed by HOA abuse,” said Rep. Schofield. “We need comprehensive reform, and we need homeowners to be engaged. Together, we can make change happen.”
“No one should lose their home over abusive fees or unfair practices,” added Rep. Scott. “We are standing shoulder-to-shoulder with homeowners to demand fairness. These hearings are the people’s chance to be heard.”
These representatives include the following descriptions of their legislative package that aims to combat HOA abuse:
Reps. Davis, Scott and Schofield’s Housing & Transparency Package (2025–2026):
- Community Association Transparency & Protection Act (LC 62 0026, refile of HB 303): Establishes an ombudsman and stronger protection for homeowners in HOAs, POAs and condo associations.
- Homeowner & Community Association Accountability Act (LC 62 0041): Creates a Homeowner Protection Division to investigate complaints, require financial disclosures and enforce fair practices.
- Homeowner Ombudsman & Dispute Resolution Act (LC 62 0042): Provides mediation, legal help and oversight under the Attorney General’s office.
- Community Integrity & Transparency Act (LC 62 0043), Fair Property Practices Act (LC 62 0044) and Community Accountability Act (LC 62 0045): Raise foreclosure thresholds, ban insider deals and require fair dispute resolution.
- Right to Information for Homeowners Act (LC 62 0046): Gives homeowners guaranteed access to HOA financial records and audits.
- Transparency in Property Assessments Act (LC 62 0065): Requires assessors to publicly disclose properties used in valuations and prohibit corporate sales from inflating residential taxes.
- Property Owner Rights & Accountability Act (HB 1032 Refile): Ends abusive foreclosures by HOAs for unpaid fees.
- Georgia Tenant Protection & Mediation Act (HB 1059 Refile): Creates eviction diversion and mediation programs.
- Community Solar Tax Credit & Workforce Development Act (LC 59 0062): Expands solar energy access and creates local green jobs.
- House Bill 62, the Georgia HOA Accountability and Community Empowerment Act (HACEA), introduced by Rep. Sandra Scott: Strengthens transparency and accountability in condominium and homeowners’ associations. The bill establishes clear rules for board member qualifications, voting rights, proxies, quorum requirements, board size and fair election procedures. It also would require annual registration of associations, with the goal of ensuring residents have stronger protection, a greater voice in their communities and confidence that their boards operate openly and responsibly.
- House Bill 712 (LC 59 0004), a refile of House Bill 322, co-sponsored by Reps. Sandra Scott, Viola Davis and Kim Schofield: Prohibits counties and cities from adding non-tax-related fees or assessments—such as stormwater, solid waste or water service charges—to property tax bills. This legislation seeks to ensure transparency by requiring such fees to be billed separately, so homeowners are not misled or burdened by hidden charges on their ad valorem tax statements.
These representatives urge Georgians to testify if possible and support legislative reforms that aim to end these practices, ensure transparency and defend the rights of homeowners.

Representative Viola Davis represents the citizens of District 87, which includes a portion of DeKalb County.
